the K-1 Fiancé(e) Visa Process

The K-1 Fiancé(e) Visa allows a foreign national who is engaged to a U.S. citizen to enter the United States for the purpose of marriage. The visa is governed by the Immigration and Nationality Act (INA) and administered through U.S. Citizenship and Immigration Services (USCIS), the Department of State, and U.S. embassies and consulates abroad.

To qualify, both individuals must generally be legally free to marry, intend to marry within 90 days of the foreign fiancé(e)'s arrival in the United States, and meet additional eligibility requirements established by federal immigration law. In most cases, the couple must also demonstrate that they have met in person within the required timeframe unless a legal exception applies.

The K-1 Visa process typically begins with a petition filed by the U.S. citizen. Once approved, the case moves through the National Visa Center before the foreign fiancé(e) attends a visa interview at a U.S. embassy or consulate. If the visa is granted and the fiancé(e) enters the United States, the marriage must generally take place within 90 days. Following the marriage, the foreign spouse may become eligible to apply for Adjustment of Status to obtain lawful permanent resident status.

Many couples encounter challenges throughout this process. Gathering sufficient evidence of a genuine relationship, responding to Requests for Evidence (RFEs), meeting strict filing requirements, preparing for interviews, and navigating changing immigration policies can be overwhelming. Missing documentation or filing errors may create delays that postpone important life plans.

Understanding the legal requirements from the beginning can help couples avoid unnecessary complications while preparing a complete and accurate application.
